The Commissioner of Baseball on Monday announced a new committee devoted to determining the viability of baseball in the East Bay. In his statements Commissioner Bud Selig said that the A's owners have exhausted their efforts in Oakland.
But really, they have not.
Here's an example in this plan for a new Coliseum baseball stadium on the parking lot land of the facility.
The plan, created by architect Frank Dobson and Retail Leasing expert Bob Leste with Oaklander Steve Lowe was first introduced in 2004 and while it was presented to the then-new ownership group and A's Managing Partner Lew Wolff, it went largely ignored by them. Wolff was known to be in love with a concept called a baseball village and needed a lot of land to make that work, hence the Fremont land chase.
But the idea called for hundreds of acres of land, more than the A's organization could afford given the economy and so needing public money turned to Fremont, which turned a deaf ear to their request.
Wolff has not wanted to be in Oakland, but the Mayor's Sports and Entertainment Task Force wants to maintain the A's here in Oakland. To that end, it supports the plan you're about to see in this video.
The plan needs to be upgraded for 2009 and a financing plan developed. It also lacks an economic impact analysis and a job development report. But just eyeballing the plan I can say it can generate about 10,000 construction jobs and 4,000 permanent jobs. It calls for a new stadium, a parking structure, and a retail structure at the Coliseum as well as an enlarged BART bridge. The total cost is about $440 million but we at the task force understand that was a 2004 estimate.
The video shows much of Bob Leste's presentation to the task force last Thursday and the discussion as well as the plan itself.

Formula 1 weekend in Australia starts with an interesting race between a half-compartment of BMW 135i with parts of execution on top, a monopost and V8 Supercar from BMW Sauber F1.

With leisure suits now just a bad dream, the new sixth-generation VW Golf GTI that hits our shores in October as a 2010 model, is just as hot. That makes it pretty cool.
The new GTI , which will make its formal U.S. debut at the New York Auto Show in a couple of weeks, is no longer the power player in the segment if all you’re counting is horsepower. No, the MazdaSpeed3 cranks out 273 hp, while the new GTI makes 200 hp from its 2.0-liter turbocharged four cylinder.
You’re correct if you say that this car has the same power as the outgoing model. What makes this new GTI worth talking about is the refinement VW engineers have worked into the car’s handling, not to mention the updates to the interior and exterior.
Unfortunately, U.S. buyers will not be able to get several features available on European-spec cars, like Dynamic Chassis Control that allows for three settings– comfort, normal and sport–of the car’s shock absorbers. Other items like dynamic cruise control will also not make it to the States. HID headlights, standard on the outgoing model, will be optional on the new car.
The U.S. VW folks say they kept the standard equipment list limited in order to keep down the cost of the three- or five-door hatch (the five-door is a $500 option). But the standard feature list is quite high, so don’t think all the models we get will be strippers. Official prices were not released at our initial test drive, but expect the car to start around $24,000, making it relative bargain in the front-drive sporty market.
So while this new GTI looks much like the fifth-generation car, every body panel (save for the roof) is different. The interior, likewise, is further refined with a better-looking center stack and chrome-trimmed gauge cluster. And yes, the plaid cloth seats are still part of the package. Some things from the ’70s just never go out of fashion.
The base transmission is a six-speed automatic with a six-speed dual-clutch tranny as an option. VW says a seventh gear, available on other VW models, is not necessary here because of the engine’s 207 lb-ft of torque. We sampled them and like both for different reasons. But if we’re headed to our garage, we’d save the $1,200 (approximately) on the DSG and spend it elsewhere…the six-speed manual is damn good.
On our initial test drive of the car, we found it to be quick and fun to drive, which has long been the GTI’s trademark. A decent rumble is emitted from the twin tailpipes, and while 200 horsepower may seem anemic amidst all the 500-horsepower ground beaters available today–the car doesn’t lack for oomph.
The sixth-generation car features subtle changes from its immediate predecessor but can easily trace its lineage back several decades, and is a worthy successor to the hallowed GTI badge.

Another reason that has delayed the launch of these new models, Audi is not to promote the next version to the end of the year, usually known a significant drop in prices. The Audi Q5 and the two versions of the Audi Q7 will be sold as Audi 2010 models.
The Audi Q5 has for a long time under development, intended to indicate that everything will be built on the platform of the VW Tigua. It will be the direct competitor to the BMW X3 and upcoming Mercedes-Benz GLK.
Moreover, the Audi diesel version of the Audi Q7 which will be marketed around the same time, take a Audi V6 engine with 230hp and 400 lb-ft of torque. The powertrain will meet the environmental requirements of 50 states in the USA. According to the director of Audi in this country, Johan de Nysschen, "there will be only to adjust certain details so that the diesel engine is offered in future models Audi A4, Audi A6 and Audi A8.
The three models including the Audi Q7 Hybrid V6 280hp will be revealed at the Audi Detroit Auto Show 2009.

Car Restoration
Classic car restoration is one of the most rewarding activities a car enthusiast can perform. Transforming a “seemingly old car” back into a classic vehicle in all of its glory is nothing less than art.
Car owner must know how to properly evaluate the condition of a car and then establish the level of car restoration to be performed to such vehicle. There are 4 levels of classic car restoration. These are the top tips for classic car restoration who want to reverse the effects of ‘the sands of time’ on their vehicles:
1. Inspect your car very carefully, top to bottom, inside and out; use strong flashlights to inspect the trunk, the engine area, etc. If possible take it to a car shop where it could be lifted to take a good look at the condition from beneath. Here you will determine if the car restoration process is worth the time and money.
2. After inspecting the vehicle, it is also important to decide whether you have a ’solid’ car which can be restored without replacing the entire frame, floor, axles, etc. By ’solid car’ we are inferring that the car structure should be strong, as well as the floor; a little rust can be repaired but a completely rusty car which has the entire frame compromised will eventually crumble.
3. Decide whether you want to work with a “friend who knows how to repair cars” or a professional. Cars restoration did by people other than professionals tend to run well for a couple of years and in some cases start to breakdown thereafter.
4. Decide the level of car restoration:
a. Driver car restoration: is often performed to get a car back to a fully functional and operational condition, they often include part replacement and minor cosmetic adjustments.
b. Street Show: this car restoration level involves getting a car into a fully working condition and repairing all major cosmetic problems (body work is required).
c. Show Car: restoring a classic car back to this form often requires professional work, if judged by a professional, there restorations and labor quality will fall within the 90-95 point range.
d. Concours: this is the highest level of car restoration possible. All the work should be done by professionals, from part replacement to body work.
5. Start the car restoration process, if possible follow a 2 step procedure (part replacement and chassis adjustments). Visit the car shop as often as possible to make sure the right work is being done.
6. Take it for a ride and see if it works correctly.

An important issue for fuel cell vehicle at the moment, “range”, “sub-zero start”, “FC improving the durability of the stack” and “cost reduction” in the fourth. The range is as was mentioned earlier, on par with gasoline vehicles already achieved more than 500km. Loss and loss of electrical energy and heat loss of the inverter stack 15 percent reduction by increasing the amount of regenerative energy of the vehicle, model year 2005 about 25 percent more fuel economy improvement. The addition of hydrogen filling pressure from 35MPa and 70MPa, about the amount of hydrogen can be used to expand the volume of the 1.9-fold improvement.
“Starting below zero” for the problem is almost solved. The fuel cells produce energy to produce water with Originally, the system starts to freeze it in below freezing water was a major challenge. The supercooled state of water - the frozen state before solidification of water - sustainable technology, and the matter settled. Today, Toyota and other manufacturers, minus minus 25 ℃ and 30 ℃ of the system can start. “We went to the testing of the Canadian Arctic. Minus 30 ℃ following morning, it was minus 25 ℃ day following a cold place, I could start without any problems no” (Mr. Masuda)
“FC Stack Durability improvement” in reducing the degradation by chemical and physical endurance has improved steadily. The current challenge is to curb further deterioration catalyst and electrode.
The challenge is the most popular, and “cost reduction”.
Of the possible measures, the larger two. First, in the field of design, and simplification of the FC system to smaller and lighter stack. Then, in the materials sector, in cooperation with materials manufacturers, FCHV promote low-cost construction material of the car. This ultimately cost Mr. Masuda’s tenth goal of the talks. Particular challenges, FC, and reduce the amount of platinum and other precious metals used in the stack, both increasing efficiency and compact, complete with cheap how to enable the high-pressure carbon fiber tanks to take a driving range.
And resolve issues, and Masuda 2015, aims to spread to the general public will begin to speak, concluded as follows.

Hydrogen-diesel from BMW
Hydrogen-diesel from BMW
Engineers from the BMW developed a new cylinder head for hydrogen operation based on a production diesel engine. BMW designed high pressure injectors for direct injection of hydrogen into the combustion chamber with pressures of up to 300 bar, nearly 4500 psi. With the diesel base, however a much better efficiency, with the new technology reached 42 percent and this is on the level of conventional self-ignition. The series using the new technology are technical side, according to Development Director Falk Gerbig no insurmountable obstacles contrary.
The project H2BVplus, an H2-ignition combustion process as a possible cars propulsion of the future will be further investigated. With regard to performance and efficiency can be distinguished from conventional diesel interesting aspects derived. The H2-ignition concept is to increase the efficiency and specific performance is expected.
Still holds the BMW hydrogen combustion because of the relatively low technology and low cost space, particularly for a good alternative to hydrogen fuel cells

The elevated rail line would use cars “built by Detroit Three automakers” that would use solar energy to power hydrogen batteries, said Justin Sutton of Whitmore Lake, founder of Worldwide Hydrogen Super Highways, which has designed the rail system. The proposed speeds for the maglev train is up to 200mph (322km/h) although the Shanghai maglev easily reaches 268 mph (431 km/h) but hardly its full potential.
The magnetic rail cars would carry passengers, vehicles (like a ferry) and freight. Sutton said the rail line could be used by many private operators that own the cars, similar to railroads that are shared by railroad companies.
The roadster of F-Cell of Mercedes-Benz is with electrical motor by a combustible battery located at the back of a power of 1.2 kilowatt (1.63 power in horses). Its high speed is low, they is 25 km/h and carries out an operating range of 350 kilometers. It has large wheels. Found inside the vehicle the following elements: a handle replacing the conventional seats of wheel and bucket in carbon fibre.

Mazda5 hydrogen About the hybrid is the second model available in the trade of the manufacturer with the rotatory hydrogen engine. Since 2006, the RE of hydrogen RX-8 for the businesses of leasing released, contrary to Mazda5 hydrogen About the hybrid, but of him is only by its rotatory engine and any additional electrical motor on board.
The hydrogen of Premacy About the hybrid comprises a hybrid gear box series-type, which combines the rotatory engine of the hydrogen of Mazda with an electrical motor. The output of engine is converted into electricity, which then actuates the engine which leads the wheels. This hybrid system amplifies the range of hydrogen fuel of the hydrogen of Premacy About the hybrid with 200 kilometers, twice the range of hydrogen RX-8 About, and increases the best performance of roughly 40 percent, with 110 kilowatts.
The alternative of the hybrid ordering of series of Mazda combines the rotatory familiar hydrogen engine, the push of a button on or the gasoline or hydrogen (duelle installation containing hydrocarbon) functions with an electrical motor. The system converts energy derived from the engine of combustion into electric current, then the electrical motor and to drive of this fact the vehicle.

Carbonite Online Backup Company Loses Data; Carbonite Is At Fault
0 comments Posted by ai at 5:58 PMI had to post this because it's a classic example of not taking responsibility for something you did wrong. The online backup company Carbonite reportedly lost a lot of client information : the data of over 7,500 of its customers who trusted it (past tense now) to keep their information in a protected area of cyberspace: a cloud they developed and around which their company is built. Now as long as I've been at this I've always got an earful about "backing up your data" so I would think a company like Carbonite, which is entrusted with protecting data, would be backing up the data they're charged with protecting. Right? Right? No. They lost the only data copies they had online, and so now are -- get this -- suing the hardware makers! If you think that's funny (strange), so do many in the blogsphere, who think as I do. Take a look at these comments over at TechCrunch : 1) What happens when you get burgled?
We got burgled last week and they took all my local backups. Fortunately I had it all backed up on S3 (and elsewhere too) which saved the day. Not having an offsite backup is a recipe for disaster.
2) They didn’t even have a proper backup? Feels sorry for those who have lost valuable data…
3) “The danger of storing your data in the cloud”
What you should have wrote was:
“The danger of storing your data in the cloud that’s not Amazon.”
Why pigeonhole the real company thats does cloud right for a company that tried to compete against them and failed?
4) No excuse. Carbonite need to accept the blame regardless of who actually caused the problem. It was their decision to use whatever suppliers they chose. I fail to see how they can recover customer confidence after a fiasco such as this.
5) This is the scary thing with putting your data with a company you’ve never heard of. I guess for that matter, putting your data with anyone is a scary thing. Has anyone used amazon s3 with success? I still feel like a drobo or hp media start server is the way to go. Backup is a tough thing.
6) The issue isn’t who the company is but how it does business. I work with a local IT company and we offer various kinds and flavors of backup, typically 3X redundant (live volume, local sync volume, local removable backup volume, offsite RAID). We do this all ourselves with system(s) we built. We started offering backup/recovery because of things like this. I recently moved a customer from a Big Brand Name Backup vendor. Said vendor had not run numerous backups. Said vendor charged ransom to provide the data when the customer quit. Said vendor basically refused to play nice with anyone, even when paid. Carbonite is not expensive but is obviously better at marketing than they they are at solution design (or accepting responsibility for their own mistakes).

Monday Notes and Tater talk.......
Well Kids, The week started in a semi normal way today. This is a nice change from the recent bucket of ass that's been visiting here recently.
Normal and uneventful is A-OK with me.
Other than the fact that medical bills are gonna send me to the poor house everything is cool.
I planted Potatoes today. I'm gonna have an ass load of Taters this year.
I planted 3 kinds. Standard Kennebeck, Red Pontiac and Yukon Gold. One bed of each. Beds are 4'x12'.
Here's how I grow Taters. I plant them sorta shallow and as they start growing I cover the growth with a mix of soil and straw.
I leave a little bit of green sticking out. Taters and Tomatoes (and maybe some others) will send out roots from any part of the stalk that gets buried. What this means with Taters is that from these roots there will be more taters than just the ones from the original start. This is a good thing.
Keep burying that growth till about the end of June or the beginning of July. You'll get layers of Taters all the way up. Kinda like adding vertical layers of growth.
I used to get scrap pallets and screw them together and grow 'em in those. You can get a nice pile from a small area using this method.
I'll put a few posts around the Tater beds and string some chicken wire around them to hold things together as I build up the whole mess.
Besides getting a lot more Taters from the same area, another advantage to this is that it is easy as heck to harvest them. Just pull the wire or pallets apart and rake the pile out. The only ones you'll have to dig are those on the bottom and if you plant them shallow it's not much digging.
Some people use old car tires this same way. Just add a tire and soil/straw mix as things grow up.
One thing to remember - Make sure that no Sunlight gets on the taters. So cover them well as you go. Sunlight makes Taters turn green and the green ones are not safe to eat.
OK. You got that?
So you can grow taters even if you only have a small space.
It doesn't take a lot of space to grow a lot of food. With just a bit of creativity you can grow a lot of diffent things in a small space.
As far as getting seed taters, I've just gone to the grocery store and bought what they had and used them before. So unless you're picky about a particular type, it's not really necessary to order them.
There's lots of ways that you can utilize the space you have to grow some good food. I had a heck of a productive garden and yard when I lived in town. We grew a huge amount of things on our little 1/4 or 1/3 acre city lot. Including fruits and English Walnuts.
If you want to see how productive you could be, check these guys out. - Little Homestead in the City
Don't let all the California, HippyShit detour you. These guys have got a fabulous place and may be on the cutting edge of what home food production is all about.
It's obvious that these people have been doing this for awhile and have it figured out. I can't imagine how many years it's taken them to get this proficient and productive. PLUS. It really looks nice.
Screw cutting grass. Grow something that tastes good.
I have to admire people who go into projects like this and excel in this way. Think about what you could do with 5 acres?
As you can guess, I have been.
Gratuitous Picture of the Day -

I went to the San Francisco Game Developer Conference with my friend Sierra Choi (who did some executive producing work of the whole event) and after the end, I met her to talk about the GDC and -- my idea -- to enjoy a nice day outside at Cafe Americano on the Embarcadero. As we were in the cab we talked about the GDC, Alternernative Reality Games, and Sierra's ego (LOL!)
Sierra sees ARG's as not games, which is where we disagree. The point is that any game is designed to get you the player to do something. That's the case with ARG's. Sierra thinks that's more social psychology but my explaination is that concern is central to game making. Again, getting a person to "do a thing" is a central tenant of game making.

Bodykit, Headlight Taillight buat CRV2004
The second-generation CR-V was all-new for the 2002 model year and remains one of the most popular compact sport-utility vehicles on the road, offering a unique blend of SUV versatility, top level safety performance, car-like handling and Honda quality. The Honda CR-V is powered by a 2.0-litre, 16-valve, DOHC 4-cylinder i-VTEC engine producing 150 hp and 190 Nm of torque. Fuel economy is pretty good for 4x4, especially with the 5-speed manual. A 4-speed auto is optional.
The CR-V utilizes a 4-wheel independent suspension system that employs a Toe Control Link MacPherson strut front suspension for exceptional handling, ride quality and packaging efficiency. In the rear, the CR-V is equipped with a reactive compact double wishbone suspension that helps provide additional cargo space.
Agile is the ideal description of the CR-V's suspension tuning. There is body roll on turn-in, but not too disconcerting. In twisty roads, it stuck well in the corners. With a decent amount of body roll, the Honda gently transfers weight without flopping over, as other 4WDs tend to do. Heading off into the desert is possible in the CR-V, but with only 8.25 inches of ground clearance, it's best to stay off the big dunes.
Safety features on the CR-V include advance dual-stage driver and front passenger airbags and seatbelt pre-tensioners.
For added safety, the lower front side frame and lower bumper beam have been specially engineered to engage the structural elements of cars, trucks and SUVs in the event of a crash. These advanced features helped the CR-V earn the highest rating of five stars in USA from the National Highway Traffic Safety Administration (NHTSA) for both front and side impacts.
The front seats are excellent. In most measures of interior room, the CR-V beats its competition. More surprising than the front-passenger accommodations is the space and comfort provided by the CR-V's rear seats. The rear bench is neither too soft nor too hard, and allows passengers to travel for more than a few minutes without getting numb-reared or fidgety. All three rear positions have three-point belts and head restraints, something not all SUVs offer.
The cargo area of the CR-V measures a generous 72.0 cu. ft. With the fold-and-tumble rear seats stowed, the CR-V can accommodate two full-size mountain bikes with no difficulty. The 60/40 split rear seats offer six inches of fore and aft travel to maximize either cargo or passenger space. The large rear cargo floor also doubles as a portable picnic table with folding legs. In front, the center console mounted storage area is now large enough to accommodate music CDs.
The CR-V is offered in well-appointed 4WD trim levels. All models include dual mirrors, intermittent front and rear window wipers and washers, air conditioning with Micron Air-Filtration, power windows with auto down and auto up driver's window, power door locks, floormats, engine immobilizer and anti-theft system, cruise control, two-texture seating surfaces, sunglass holder and rear coat hooks.
The basic RVi trim level incorporates an AM/FM/cassette player with four speakers. The top RVSi trim includes an AM/FM/cassette player with six speakers, a power moonroof, foglights and keyless entry. Honda's Real Time' 4WD is standard on all models.
The CR-V is a practical alternative to a full-size 4WD, being easy to maneuver in traffic and offering good fuel economy. But passing on the highway is an annoyance due to its low power output. It is offered with the Accord's 2.4-litre engine in some markets, but has to make do with the 2.0L over here. Plus it's not a true offroader. However, it has proven to be as reliable as any other Honda, with strong resale prices, and would be a good buy for a small urban family.

TGIF .........
I'm glad this week is over. Way to much going on.
All things considered it's turned out pretty well.
With the GrumpyWife in the hospital Monday, I was fortunate to enlist a coworker, the lovely and talented Emily, to assist me on my trip to the surgeon for the Bionic Eye.
Big thank you, Emily. Don't know what I'd have done.
The wife had to go to the Big City Hospital yesterday for a Cardiac Cath proceedure.
Good News and Bad News.
Good News - Her arteries are clean as a whistle.
Bad News - I'm probably stuck with her for awhile longer.
OK, that's not really bad.
The Bionic Eye is taking a bit of getting used to, but all's well and my vision is getting better everyday.
Hopefully I won't have trouble at work this weekend like I did Wednesday. I doubt it will be a problem.
My Buddy Jerry went to an auction last Friday and picked up a slew of Guinea hen babies (known as Keets) and I went and picked them up this afternoon.
There's 10 of the little buggers on the kitchen cabinet now, making little Keet noises.
They are quite cute when they're little, but they get pretty ugly as adults.
But I like 'em. They're fun to watch as they move around the place.
They also eat Ticks like machines. So if you have a lot of Ticks, get Guineas.
They're noisy as hell and squawk all day, but I like that too.
He also sent me home with a 6 pack of his homebrew beer!
Oh hell yes.
Can't complain about that.

Summer Job you may not have thought about.
On May 19th Alameda residents will be able to assure the economic future of the City of Alameda by voting for the Alameda Point Development Plan for the redevelopment of Alameda Naval Air Station as planned by the Alameda Base Reuse Committee and its subsequent evolutions to the Alameda Reuse and Redevelopment Commission of today.
The plan consists of a mix of uses and an ambitious plan adding over 4,000 much-needed housing units.
But the most important fact is the plan will mark the begining of the replacement economic development we have worked to achieve for so long.
Opponents point to Measure A as the reason why the plan should be defeated, but the fact is Measure A was passed in 1973 and represents a time when Alamedans were interested in restricting development and maintaining Alameda from people of color.
Those days are long gone.
Now, Alameda needs jobs and the region wants to see The City of Alameda have an economic development project that replaces the closed Naval Air Station. This is that project.
Alameda, CA To Hold Election on Naval Air Station Development at Alameda Point
0 comments Posted by ai at 2:25 AMNews is coming in from accross the pond that the election season has started early in Alameda this year and it looks like islanders are finally going to get a chance to make something exceptional happen out at the city’s run-down old Navy base.
The backers of a plan to clean up and reuse the old Naval Air Station at Alameda Point today submitted the initiative language to the city. Now they will start collecting signatures to place the plan on the Nov. 3 ballot.
This is frankly great news for Alameda. That old Navy base has sat unused and neglected for a long, long time. Finally a plan that someone can pay for is coming forward to get the place cleaned up and ready for real public use again.
A lot of ideas have come and gone out there, but this is the only one makes any damn sense at all.
Look, this has been a long time coming and I’m sure voters are going to get an earful from professional nimby’s who will oppose anything that even resembles a plan that could actually be achieved. And see my video for the real story.
The problem with that mentality is that, like it or not, without a viable plan this site will either continue to deteriorate and be blight on the City, or it will be sold off piece by piece and developed haphazardly.
This plan will work for people who live in Alameda. It will certainly be a benefit to the East Bay by creating jobs, new parks, a huge new sports complex, a new ferry terminal and new public transit connections, new trails and new access to areas that have long been fenced off and off limits to anyone not in a white suite.
It is too easy to oppose something in the Bay Area. The hard job is to support something that makes things better. Looks like the Mayor of Alameda has joined the cause—let’s hope sensible people will study the plan and make that same logical choice. It is far better to support something that will clean up the toxic lands, create jobs, bring open space and sports fields to the City, create affordable housing and build better transit connections in the region than it is to hold out for something that can never be achieved.

What Does It Take to Win Gold In the 90 and Over Age Group at USATF Nationals?
0 comments Posted by ai at 11:38 PMThe astounding 93-year-old Leland McPhie could tell you, after picking up gold medals in the high jump, discus, and shot put at the USATF West Region Masters Championships in Occidental College in Los Angeles, CA. That's 200+ gold medals for this 1937 collegiate champion.
A fun article on Leland here at the San Diego Times. He sounds like quite a character! I can only hope to be this active when I hit my 90's.

What's New in the News?
Well, I've missed a bit over the last few days.
Tam, over at View from the Porch Brings both of these two things to my attention.
U.S. seeks expanded power to seize firms-
"The Obama administration is considering asking Congress to give the Treasury secretary unprecedented powers to initiate the seizure of non-bank financial companies, such as large insurers, investment firms and hedge funds, whose collapse would damage the broader economy, according to an administration document."
WTF? The first line should be - "In a move that would make Hugo Chavez smile....."
But I'm sure Bill Ayers is smiling and that's probably enough for, The One.
Moving on, Tam also brings This Rant from ARFCOM to our attention
And it's a beauty.
Written by a successful fund investor who gives his opinion on the idea of limiting salaries by government decree.
I liked it so much I'm gonna copy the whole thing here. (He has granted permission)
I currently manage a medium sized hedge fund (long/short equity).
The current populist uproar is absolute insanity. I don't know how else to say it. You are never going to legislate away greed. Period. It is part of the human psyche. That's all there is to it. You can either fight it, or use it. Incentives work. This is why.
Let's step back a minute and think about why and how this happened:
1. Starting back in the 1970s Congress addressed discrimination in mortgage lending (which was really a serious problem) with the Home Mortgage Disclosure Act of 1975. This approach was to open lending statistics by requiring banks to disclose the details of their lending by geography and, eventually, demographics and income level. This was a stroke of genius. Large banks were shamed into good citizenship. The act did have the effect of elevating a number of "civil rights" personalities (Jesse Jackson, for instance) as they used shrewd public relations to expose some rather egregious practices by large banks when it came to mortgage lending. These same personalities, names you doubtless recognize, in some cases, adopted more aggressive tactics, some that borderline on blackmail and extortion today. I leave it to you to determine if this downside outweighs the upside of truth in lending practices. I, for one, think that forcing disclosure like this was enlightened. It was to be the last of its kind.
2. The Community Reinvestment Act really was a serious break with the legislative practice before the legislation. Suddenly, you have a small number of people determining where dollars will flow based on some political definition of who is worthy. The early definition could be right as rain in terms of who is deserving, needs a leg up, has been wronged, etc. etc. but once you go down this path, you are truly fucked. Once you start dictating capital flows based on political worthiness (an entirely subjective and whimsical standard) you have opened the door to all kinds of mess. Play stupid games...
3. ...win stupid prizes. In the 1980s and 1990s Congress literally had a hornet's nest up its ass with mortgage regulation. Almost 400 bills in the 101st Congress contained the word "mortgage." This doesn't seem like a big deal until you realize that the housing ranged from 7-20+% of GDP in a quarter. Absorb that. Something like 1/5 of quarterly GDP. Now put in place mechanisms to literally pour trillions of dollars into the system to encourage "The Dream of American Home Ownership." Think of it. You have a small group of regulators/legislators (less than 100 people are making major decisions about how much Freddie or Fannie will lend, or what their capital ratios will be raised to, or what interest rates should be) controlling a massive portion of the economy. You suddenly have price fixing for a sizable fraction of the GDP. To compete with Fannie and Freddie, their subsidies, their tax breaks, their implied government backstop and their downward pressure on interest rates, you have to take on more risk for less money. Hello Countrywide. (Just a bit of history, Countrywide was explicitly founded to collateralize the only loans left to non-GSEs- those not already being siphoned by Freddie Mac and Fannie Mae). GSEs held 1/3 of all residential mortgages by 2001 or so. ONE THIRD. GSEs were run by political hacks, installed there as a reward for political services rendered. These are facts.
4. Banking and Insurance regulation is, and always has been, daft. The blind focus on capital ratios, reserve ratios and the like, and the pedantic concentration on definitions of risk that results in notional insured figures being counted in capital ratio calculations but credit default swaps not counted in this way was insanity. Of COURSE massive capital is going to flow into the exception you, regulator, have explicitly written into the regs. Now you are shocked and surprised that people wrote Credit Default Swaps like there was no tomorrow? Incentives matter. Period.
ETA: I am not stupid enough to ask you to explain to me why you cannot just let dying firms in dead industries FAIL? Watching an airline enter its THIRD bankruptcy, and proceed to wage a deleterious price war, only to suck down millions if not billions in federal aid may pull $50 off a ticket to Florida, but it also fucks the entire industry. You've created the appearance of a right to cheap airfare, cheap gas, cheap insurance, and bailout if the McMansion you were stupid enough to built on a 20 year flood plain gets- quelle surprise- leveled by a storm. Of course you can't let anything fail. You've promised the world. You've been borrowing and delaying the inevitable to deliver it for decades.
5. The market for talent is global, and you can't legislate it away. Like it or not there is a metric ass-ton of money in finance. The power to create, move or allocate wealth is very valuable. It always will be. You aren't striking a blow for social justice by enacting the first salary caps in the modern history of the United States. You are guaranteeing that finance experts will flee. The hiring binge going on right now as the likes of UBS suck out talent is just amazing. UBS, with the support of the Swiss Government, is offering 10 year permits to execs and their families who relocate to Switzerland, not to mention the ability to negotiate your personal tax rate for the next 10 years up front in some Cantons. You can't determine what finance execs will be paid, folks. You can only determined WHERE they will be paid. Who exactly do you think is going to pull the United States out of this mess. Big Auto?
So, let me get this straight, Mr. or Ms. Congressional/Executive Scumbag....
You've spent the last two decades pumping trillions upon trillions of dollars into particular segments of the mortgage market, a major portion of the U.S. economy, dictating what risks were appropriate, how much would be paid for assuming those risks and generally underpricing risk in the entire system for years and years. You've been inflating a bubble and assuring that the inflation passed to the riskiest portions of the economy. You've been passing the buck for four decades. Every time the economy tries to correct itself, you stall, pump borrowed money into the system, and grow the disaster the country will eventually have to face. You buy votes year after year by delivering graft now, to be paid for later (after you've long left office). In effect, nearly one third of the American economy has been run by central planning for the last five years. During this inflation, you happily collected taxes on everyone, effectively collecting tax on borrowed money and inflated assets (none of which you propose to repay- what luck would I have asking for the real-estate taxes I have paid for years on appraisals that were pure illusion?) I didn't hear you complaining when you saw massive, record revenues to the Treasury thanks to the boom the finance community facilitated and delivered to you, year in and year out. I didn't see you pointing fingers when we dug in and pulled your ass out of two recessions. Finance is a massive portion of the economy because it creates wealth. Period. Your social programs, state and local, are massive bloated vote-buyers because of our hard work, sweat and craft. (New York State, I'm looking at you). We work until mid-May for you and your vote purchasing juggernaut. I accept that. I have for years. This is because what I make from June to December is more than enough to, not just enjoy the American Dream and the promises of success and wealth, but to take the capital I collect over the years and invest it, again and again back into American business, start-ups, and even your fucked up GSE mortgage securities (which my taxes support). We carry the freight. 10% of us pay 70% of all income taxes. 50% of us pay 97% of all income taxes. We tolerate this because this is the promise of America. Work hard, pay taxes, and no one will second guess what you spend your money on in your personal time. No one will tell you how much is a "fair wage."
Now, now that you have run out of delaying tactics, you want to point the finger at... me?
I came to this country for a reason. I spent 9 years in U.S. universities, which I busted my ass to get into. I didn't borrow a dime to do it. I paid every cent myself. I've never so much as accepted a single unemployment check. I've never availed myself of any government largess that I wasn't forced to take. I have repeatedly declined to challenge some of your more deluded tax claims against my income in court, as was my right. Two of these I clearly could have won, though expensively. What's more, I consider myself a patriot. I consider it a great privilege to live in the United States and to be called one of her adopted children. I defend this country, and what used to be her ideals, to any European socialist moron who cares to engage me in conversation. I support the troops. Wherever they are. Unconditionally. I create jobs. Aside from two years where I broke even, I have made money for my clients and partners every year since I have been in professional life. This includes 2008 and 2009 YTD. You could house 50 families in reasonable comfort for 10 years on what I have paid in taxes since I've been here. Actually, now that I've actually done the calculation just now for this post, you are really pissing me off.
Now you want to call me greedy? Are you fucking kidding me? After you fucked this place up? You want to tell me that capitalism failed? What capitalism? You've socialized/centralized almost half of the GDP. Now, you want to use me and the paycheck I've earned year after year to deflect attention from the basic fact that you have been shoving debt on people who couldn't hope to find within themselves the character to take responsibility for repaying it? They get a pass and I get... what... a sharp stick in the eye?
And, you want to tell me that $250,000 is "enough?"
I will tell you what is "enough." Me paying for your power grab for the last decade now. That's quite enough.
Let me just tell you, Congressional/Executive Branch Scumbag, Esq., if you do this... if you take this turn... I won't even think twice. I will move my firm to Switzerland, or to London before the year is out. Those employees who do not follow me, I will have to fire. The corporate taxes I pay will no longer be yours. Instead, they will go to something useful, like a nice tunnel through a mountain for high speed trains that actually work. Further, I will dedicate a substantial portion of my personal time, effort and capital to frustrating your every attempt to collect personal taxes on me thereafter- given your draconian anti-expatriation laws. But that's not all. My job is to make money for my clients, in whatever way I can. I will short your flagging financial firms mercilessly and remorselessly. I will buy QGRI puts to bet against any firm that took bailout money. I will buy credit default swaps on every firm you put your greasy paws on, because I know your fingerprints are laced with poison. For every boneheaded centralist move you make, I will be there, profiting from your lunacy. I will never again take a client who pays taxes in the United States. I will not permit any capital or profit to be diverted to any such. I will do this because in the same way you believe it your divine right to punish "greed," I consider it my duty to punish the stupidity and arrogance that is central planning, and because I believe in economic freedom. I will divert as many of your resources to my new home and its relative economic freedoms as I can. I will promote free markets in this way, and I will never look back. You will have made it clear that you are my enemy, and I do not forget such declarations.
I take no pleasure in this fight. I did not ask for it. I only asked for liberty, and the pursuit of happiness. Deny me these at your peril. In the end, I can only hope I'm not alone.
That just kicks ass and reinforces my belief in "The law of unintented consequences". Screw the productive people and they will just take their talent and go where the climate is more amenable.
See California for reference on this.

Tuesday Afternoon......
Here's a quick update.
The good QueenBuffness is home at the Bunker and doing well. Thanks for the well wishes.
My surgery went ok and I'm stumbling around trying to get accustomed to the new Bionic lens in my eye.
Pretty amazing really.
I did something this morning that I have never before done in my life.
I went in and bought a cheap pair of sunglasses and wore them out of the store. I've had glasses since I was in the first grade and have never just bought a pair of shades before.
I can't see shit within 3 feet right now, though that will get better as things settle in. I'm gonna need reading glasses of some kind. They gave me a pair this morning after my follow up exam and they help with close work.
In about a month I'll be able to get some reading bifocals to put in my old frames and whatnot.
What little I've done today is mostly garden stuff.
Planted peas and some more spinach.
Transplanted some more tomatoes out to the HoopHouse and a couple into the outdoor Wall-o-Waters. It's still a bit early for them even, but I'm counting on Al Gore's global warming to keep everything ok.
Transplanted a few raspberry plants to some new spots.
Made sure all of the newly planted trees, grapes and berries had a bit of water and cleaned and prepped a couple more beds.
Not a heck of a lot, but This eye is taking a bit of getting used to and I just don't feel like doing much. So I won't.
Gonna try to work tomorrow. That may be interesting. We'll see how it goes.

In the wake of the Oakland Police murders, the Associated Press and CNN have given a false view of Oakland as having "tentions between police and community" and that is not true. Oakland Police are part of our family.
Economist Paul Krugman has been attacking the Obama / Geitner Troubled Assets Relief Plan (TARP) as using taxpayer money to pay investors to take the assets off bank's hands. But he offers no alternative. Paul is wrong in that he wants the "bad assets" to remain on bank statements, but for what? To continue to freeze the credit market? His blog posts in the NY Times on this matter are intellectually sloppy at best. That -- for a Nobel Prize winner -- is terrible.
Krugman sets up straw person examples to prove the idea that the investor spends little of his or her own money -- but that is the idea. I do not know why he comes up with these half-baked statements at all. Perhaps he is just angry that Obama did not pick him to be economic advisor.

When One Car Accident Changes Everything (aka, Another Reason To Stay On Trails)
0 comments Posted by ai at 12:21 PMJamie Thompson of The Dallas Morning News writes a chilling story of three runners struck by a car after the Dallas Half Marathon. It's a harrowing recall of the accident, the storm of emotions, and the road back to recovery. Read the full story here.
When I hear about these incidents, I am so thankful to be able to run trails regularly. I might get a few scrapes and bruises, but I never have 3,000 lb steel monsters jumping at me from behind.

I created this video to open the panel discussion on "Blogs, New Media, and You: Managing Your Digital Identity" at the WISE-SF Panel Discussion held a year ago Monday, March 30th 2008 at The Hotel Kabuki, at 1625 Post St. San Francisco, CA.
It's interesting to look back and review the video. What strikes me is that the basic theme is "expression" in that New Media allows one to express a view.
